Land Use and Environmental Law

David Waite has practiced environmental, land use and municipal law for over 20 years. His environmental practice includes complex environmental litigation, including CERCLA cost recovery actions, RCRA citizen’s suits and Proposition 65 litigation. David advises clients on complex brownfields transactions involving environmentally contaminated property.

His land use and real estate development practice includes zoning, CEQA compliance and California Subdivision Map Act proceedings. David has litigated actions involving vested property rights under California law. He regularly appears before City Planning Commissions, City Councils and other government agencies on land use entitlement and regulatory proceedings.

The Land Use and Environmental Law Section will provide timely information and updates to CCBA members in the area of environmental and land use law, including regulatory compliance, transactional representation and litigation. This will be done through a series of MCLE breakfasts and luncheon programs throughout 2007. Key areas of focus this year will include: 1) transactional counseling involving the purchase and sale of contaminated property; 2) obtaining land use entitlements, permits and approvals from governmental agencies; and 3) current trends in environmental litigation.
